BC Rules on Separate Representation

  • Mandatory Disclosure: REALTORS® must explain their agency relationship with you before providing services.

  • Separate Representation Required:

    • A single REALTOR® cannot represent both a buyer and a seller in the same transaction (called dual agency) except in very rare, remote-location exceptions approved by the BC Financial Services Authority (BCFSA).

    • If both parties want representation, each must have their own, separate REALTOR® from different brokerages or from the same brokerage but acting independently.

  • No Representation (Unrepresented Party):

    • A REALTOR® working with one party may assist the other only in a limited, non-representative capacity (e.g., relaying information, but not advising or negotiating).

  • Written Agreements: Agency relationships must be confirmed in writing, outlining duties and obligations.
